Our Case at Sup.Court.

Our case came up before the Registrar of Sup.court on 26th Nov.2009 and as usual the management did not reply and last chance to reply was given by the Registrar in all but one of cases and service of notice on three respondents to be done by Registered Post and it is likely that the case may be posted before the judge only in the hearing next to this.

We are patiently waiting for the final tussle and will work for the victory with all your co-operation and perceverance.

Case at Sup.Court for pensioners with 20yrs less service

Dear Friends,
As informed you earlier the case for SVR Optees with 20yrs less service asking for pension was listed for 9th Nov. 2009 before the Bench Headed by Hon'ble Judge Jain. With due caution Our assn. represented by Sri. Nagarajan Genl.Secty., went to Delhi with our Chennai Adv. Sri.Parthiban on 7th Nov and held a conference with our Sup.Court Advocate Sri. Dayan Krishnan. To our surprise a letter was delivered by M/s Law Associates, Adv. for the Management, which was addressed to the Registrar of Sup.Court requesting him to adjourn the case since they will not be able to attend on that day due to personal reasons. We were very much worried with the attitude of the Management and giving the required line of action to the Sup.Court Advocate came back to Chennai on 8th itself.
On 9th November, in the afternoon when the case was taken up for hearing, we all expected the case to be adjourned. But to our surprise Attorney General Sri.Nanavathi appeared for the management and vehemently argued for the case seeking leave. Since nobody expected Sri Nanavathy to appear for the management, especially when' they ' circulated the letter seeking adjournment, we were taken aback and Sri Nanavathy is of that stature, Judges will grant leave just at the sight of him. God was with us. Fortunately Our Advocate Sri.Dayan Krishnan rose up and objected to the Judge that the minimum basic necessity of circulating the change of Advocates is expected at Supreme Court, and it is a case of Pensioners and Leave should not be granted without hearing our arguments and the final trial should be ordered. Even though the Management made a big show by appointing the costliest advocate spending so much of money for a single appearance Judge did not budge and saw the genuinity in our demand and posted the case for final hearing in Feb.2010. God is with us since our advocate is only a intervener in this case and the main Advocates for the employees were spell bound at the sight of the Attorny General Sri. Vahnavathy and did not speak even a word. Justice prevailed.
Friends, Management will do any thing to stall our enthusiasm and will try to wear us out in finance and perceiverance. We will not budge. We will fight till the last. Come what may.

59 slabs have increased for this quarter and the present point is 3688. We give below the calculation for DA which can be used for finding out whether you have received correct DA increase. The calculation is Your basic pension*(present point ie3688-1740 divided by 4) * 0.0023. This is only for those retired under SVR Scheme.

Pension for svr optees with less than 20yrs of service

Dear friends,
The SLP on the payment of proportionate pension for svr optees below 20years of service is being taken up by supreme court and listed for trial on 9th November 2009. Our advocates are following the matter with utmost vigil and we are sure to get a favorable result since we have already won in Division bench of Chandigarh. We are taking all possible steps to take up the 5 years notional credit also with the above case.
National pensioners are put to maximum trouble because of some communication failure on the part of LIC and RBI mumbai and around 53 pensioners are yet to get their ecs for september. Now we have co-ordinated with the Lic officials and all the 53 pensioners will get their cheques of pension for Sep and Oct 2009. within two days.
Our machinary never rests since Service to Pensioners is the prime aim.

Our case on 19/10/09

Friends,
Our case came up in sup.court on 19th Oct '09 before the Registrar of Sup.Court. and it was adjourned to 26th Nov'09, since out of the four batch of petitions only one file was placed before the Registrar for orders and the other three files some how did not come up due to some clerical delay in Sup.Court. So orders could not be passed on those files and hence postponed to 26/11/09. The management has not yet filed their counter. We expect them to file the counter atleast by the next hearing.

Non credit of pension to National for September 09

Dear friends
The non credit of pension to National pensioners is clearly deplorable and that too in the month of festivals. We took up the matter with Head office and also directly with Lic and we are sorting out the problem. Before that i feel that all our friends should know the reason for delay.
Normally these ECS payments are done by Reserve Bank of India and for us it is through State Bank of India and Reserve Bank of India Mumbai. As usual our Kolkatta LIc has sent its list of pensioners who opted for Ecs to RBI in the first week of Sep itself.
You all should know that there are two types of ECS credits. one is banks coming under core banking ( who can operate all accounts through net banking throughout india.) and banks operating on non core banking style ( who have limited access to Computer)
Normally, till september, the LIC is sending the list of pensioners opted for ECS holding account of their pension with both core and non core banks together without any demarcation.

In the meanwhile the RBI Mumbai has sent letter to all the Banks and LIc to submit the list in seperate formats segregating the core and non core bank accounts as they have changed the format in their net working. But this letter came to the notice of LIC only in the first week of October because of the pooja holidays before which the RBI mumbai has rejected the early ecs credit request to lic noting their inability to give credit under ECS due to non submission of the segregated list of core and non core bank accounts of pensioners.
Once we came to know the problem on the 4th of this month, we mounted pressure on Head office and LIC and got sorted out the matter with SBI the credit for all the pensioners who have accounts in State Bank India. Whereas LIC could not convince RBI mumbai. Finally RBI mumbai relented and agreed to give credit to all the pensioners of Mumbai only, irrespective of the Bank whether it is core or non core.

For other states in the country the LIC is now preparing the segregated list of core and noncore bank account holders on war footing and trying to get pension credited atleast by next week.

We have already registered our protest with Head office Kolkata and also with LIc Kolkata and our representatives are in constant touch with Lic Kolkata. We got assurance from Kolkata LIC office to get the present problem solved within next week.

Hence please bear with the delay and don't be frantic in contacting the Kolkata LIc office as it will further delay the process. we have ceased off the matter and will put pressure on LIc to release the pension before the ensuing Deepavali Festival.

Our meeting at Delhi

Friends,
Our Genl.Secty accompanied by Shri R.Kumar Asst.Treasurer went to Delhi on 14th Sep and stayed there till 18th, to have a meeting with our Advocate. We discussed about the recent introduction of another SVR Scheme for the Tariff Advisory Committee Officers by IRDA which had the extraw clause for payment of arrears and the judgement by Sup.court allowing 5 years notional credit to bank SVR Optees and their bearing on our case.
After thorough discussion, our counsel was postive in his response and said these cases will difinitely help us at the time of trial. He also assured us that the hearing on 19th October will be final at Registarar's Office and the next hearing will be only in Court and asked us to be prepared financially for fighting the case once the Transfer Petition is admitted.
We also had meeting with our counter part at Delhi and they assured us all financial help for fighting the case. We are thankful to Shri Dwivedi for his whole hearted support to us and also for the other office bearers of Delhi Unit.
We met the Chairman of Oriental Insurance Company Shri. Ramdoss and thanked him for immedietely implementing the direct payment facility on Mediclaim for OIC retirees. We further made our demand for inclusion of parents also and also for speedy implementation in National and New India.
Please note that the new SVR Scheme introduced in TAC has got a specific clause allowing the arrears, if the scheme is implemented during the course of implementation of the above scheme, Whereas this was denied to us.
We are vigilant and watching the developments and we are hopeful that wisdom will prevail upon our management to pay our legitimate dues.

OUR CASE AT SUP.COURT

Friends
Our case came up for hearing on 13th Aug 2009 and the Registrar ordered for filing the Counter by the Management giving them 4 weeks time and adjourned the case to 19th Oct, 2009.
Now the management has more than 4 weeks time and we expect them to file the counter without fail before 4 weeks. We are also planning to meet the management for filing the counters at the earliest.

The other case, which is seeking pension for those who did not complete their 20 years and denied pension after opting for SVRS is coming up for trial on 24th Aug 2009 and Our advocates are representing the case. at Delhi. the case is numbered at 67 and we expect that to come up for trial.
Let our prayers be with our advocates and victory will be ours.

Mediclaim cash less payment for us is also progressing very slowly but we are putting maximum pressure and trying to bring the same in all the other three companies.

OUR CHENNAI MEET

The Chennai members met on 1st Aug 2009 and exchanged views and was attended by more than 130 members. The meeting was chaired by Shri AG Gajapathy and presided by Shri V.Ravishankar and our Working President gave a nice speech to mobilise fund for the ensuing Sup.Court Case. General Secretary Shri. V.A.Nagarajan explained the present financial position and spoke about the achievements we made during these years. Many quieries were answered and the inter active session was so helpful and revealing with both the members and the dias participating and the meeting finally ended with HI-Tea.
we are eagerly waiting for the 13th Aug result from Sup.Court on Transfer Petition.
Our Association thank all the members participated in the meeting through this blog.

Executive committee meeting 20/07/09

Friends,
25 members of the Executive committee met on 20th July 09 and unanimously passed the audited accounts for the year 2008/09 and further decided to hold a get together meeting for the chennai retirees on 1st Aug 2009.

Further it was decided to tour all the moffussil centres and also the places other than tamil nadu in the near future to explain the members about the present position of the Case at Supreme Court.

Committees to work for the collection of subscription in different units and strengthen the finance of the Association.

SUP.COURT CASE

Dear friend
The review before the Regtr. of sup.court came up on 10th July and the good news is that the management has responded and all the notices were served and only the notice served to finanace ministry is not acknowledged. Hence we are taking all necessary steps to get the same done at the earliest. Now the Case is posted to 13th August and we hope to get a date for hearing on that day. We are alert and trying maximum best to bring the case for early hearing.

The initial effort we have made and the successful implementation of direct payment facility in United India has forced the other companies to follow suit and we are presssing them to the maximum extent to get the work done at the earliest. One such effort has become fruit ful in Oriental and the Management of Oriental was kind enough to pass the note and now it is left to the technical department to prepare the circular and we expect the same within a weeks time.

We also spoke to the management of National and New India and National has completed the process of discussion and preparation of note is in progress. New india will never lag behind and we expect them to follow suit.
Any sincere efforts will bear fruit. and ours is one such . HAIL NISVREA.11/07/09

Meeting with Chairman UI

Today we met the Chairman United India to thank him for sanctioning the direct payment facility to all the Pensioners of United India and placed certain other demands to improve the present facility. He was very receptive and assured us to look in to the matter favorably.
We also met Shri. Kharat GM who was instrumental in giving the facility and thanked him and also insisted upon him to improve the facility.
The meeting with the out going GM Mr.Varma was very helpful since he is going to take charge at National, where we are presurrising to implement the direct payment facility under Medi Claim for all the pensioners in National. He assured us to look in to the matter once he joins National.
We are doing our duty without fail and reaping the benefits, with all our members' overwhelming suppport we will continue to serve the pensioners.

Joint account for pensioners

Friends,

It is now the turn of National Insurance co.ltd to introduce the Joint account system for pensioners. Due to our persistent demand and followup National has followed OIC in implementing the Joint account system. We are now pressing United India and New India for implementing the same. Soon we will be successful

Oriental Pensioners are not getting thier DA increase with the pension when it is due. We have taken up this issue with the Head Office OIC and LIC Delhi without much sucess. Hence we took up this matter with Sri. Sathyanandam, Chief officer P&GS LIC Mumbai and now we have received response from both the LIC Delhi and as well OIC H.O. Soon we hope to succeed in solving this problem.

our transfer petition

Our transfer petition came up for hearing on 27th april 2009 before the Registrar and the service of notices is delayed further and hence the next review will be on 10th July2009. most likely the last one.
We have some good news through Bank employees' case where they have fought for the notional credit of 5 years to all those who completed 20 years of service and went on SVRS and won the case at Supreme court.
Many points quoted by the Hon'ble judges will be helpful in our case when it is heard.
Let us pray for early hearing and disposal by Sup. Court.

Mediclaim-direct payment facility for Retirees

At last the management of United India has come out with the circular on 30 the of March 2009 for direct payment facility to Retired Employees in their company.

For Hospitalisation - 50000/- or more with a request from the retired employee and estimate from the Hospital including the ailment and other details.

Retired Employee should deposit 10% of the estimated value or 10000/- whichever is less with the Hospital and produce the reciept to the concernd office.

We have now succeeded with United India and we are now approaching the other companies and then will fight for the improvement in the scheme. Kudos to NISVRREA.

Our case at supreme Court has been reviewed and out of notices for 8 petitions but for Karnataka all the other notices have been served and our next review is scheduled on 27th April 2009. Let us hope for the best and pray for good result.

We are continuously working for the Retirees to enhance their pension at every Revision of Scheme and now the Negotiations are on in the Industry and we are also active by submitting our Charter of Demands to the Minister of State for Finance on 4th March 2009 and insisted the Ministry to invite us also to participate in the on going Negotiations. We will continue to fight for our right and in the changed scenerio after the Sixth Pay commission Implementation, Where Pensioners were given due importance, Our fight will be successful.

Pension for svrs optees less than 20yrs

The cases filed and won by Chandigarh SVR optees who put less than 20 yrs of service in Chandigarh Division Bench, is listed for hearing in Supreme Court on 10th Feb 2009. Our members from Chennai has filed an intervention Petition in Supreme Court and pleaded to be included as party in the above case. The final decision will be applicable to all employees and Nisvrea is taking all steps to co ordinate with the Advocate at Supreme Court level.

med-claim - cash less settlement for Retired employees of United india

Our Association's constant efforts to get cash less settlement for Hospitalisation expenses under Staff Med-Claim, with several meetings with United India management, ended in a fruit ful note on 9th January, when Mr. Karat GM personal has agreed to sign the basic note prepared by Personal Dept. agreeing in principle to extend the facility with some conditions. The Technical Department in United India Head office is preparing the circular and we are in touch with them to get the details and date of implementation. Kudos to Nisvrrea.
