Friends,
On 21st October 2011 our case came up before Registrar of Supremecourt and after scruitiny of papers it was adjourned to 16th December 2011 with an order to the companies to file their counter affidavit before that date.
Management is availing all the opportunities to test our patience and testing our financial strenth as they did with the Dev.Officers' case. Let us wait patiently and fight the case to the end and we all hope that it will end in our favor.
All the pensioners are requested to send their PAN no. to the LIC directly so as to enable them to prepare you next batch of cheques since the RBI has made strict instructions to the LIC not to release any Annuity Cheque without the submission of PAN no.
We have taken up with the LIC to decentralise the process of sending pension to their zonal offices sothat it is easy for us to approach, in case of specific problems. as we are forced to contact only the LIC offices at Delhi, Mumbai,Kolakata and Chennai and most of the time the telephone lines are either busy or unanswered.
We are taking all possible steps to redress the grievances of pensioners and we request all the pensioners to call on us in case of any difficulty.

Dear Friends,
We had our case heard on 25th August 2011 by the Registrar of the Supreme Court and after thorough scruitiny the case was posted to 21st October 2011 giving 4 weeks time for completing the formalities. Two other cases were also tagged with our case from Kolkatka and to our surprise.
Any way we have to patiently wait for the final Trial which we expect to come up during December.

We have taken a concrete and definite step towards solving the pensioner's problem of difference in Pension between retirees of 1986 1992 1997 2002 and 2007. We have filed a case at Madurai and got admitted and the court has ordered issue of Notice to the Management. We feel if we get through this case in our favour we will put to an end to all the problems of the pensioners. We expect full co-operation from all the pensioners and also from the employees who have opted for Pension.

The Reserve Bank of India has given clear cut instructions to the LIC that all the Annuities from Jan 2012 should be released only after getting the Pan No. from the annuitants. Hence we advice all the pensioners to send their PAN no. to the LIC directly with a copy to Head Office. immedietly to avoid stoppage of Pension Cheques.

jaipur case and further developments

Dear Friends,
The Jaipur case of LIC came up for hearing on 12th Aug and adjourned to 19th August. Whatever may be the decision of the High Court, finality can be achieved only in Supreme court and we expect this to take another year.
Taking cue from the above case, we have filed a petition at Madurai High Court, pleading for the revision of Pension, whenever the Scheme is revised for the regular employees, and it is likely to come up for hearing on 19th of August 2011. We will inform you about the developments.
Organisationally we have spread our wings to Assam. More than 50 people have joined our Association, after our General Secretary visited the place with Arumainathan. The Co-ordination of the Kolkata Unit people Sri. Shamal Banerjee, Anadhi Chatterjee and Aurbindo Ganguly for arranging the meeting and the work they have done for enrolling the members, should be commended. We have now spread to all the 7 Eastern states. The meeting was quite refreshing to them and the response was so positive that we expect more people to join our fight.
Our Pune friends conducted their first General Body meeting at Pune and Our General Secretary was invited as special Guest and accompanied by Sri.E.Rajagopalan, I addressed the meeting. The members were so thankful to us for explaining them the present position of the case and how our Associtation is going to face the management in the Supreme court when it comes up for hearing.
Now we are concentrating on collection of dues towards legal fund and subscription and we appeal to all the members to send their subscription dues and additional legal fund.

LIC CASE! WHAT IT IS?

Friends,
Now it has become a routine for all the retirees to quote the LIC case of Pensioners and ask us whether it is beneficial to us, etc. Let me explain what the case is all about.
The DA pattern adopted by the companies for payment to pensioners on cost of living index differred for those retired before 31/7/97, and for those who retired after 31/7/97.
The formula followed for those before 31/7/97 was, as per Basic Pension and for those after 31/07/97 is as per Basic pay.

Let us take an example that a person who retired after july 97.
DA is calculated on his basic pension as per the formula down below.
1)upto 4800 0.35%,
2) above 4800 upto 7700, 4800 0.35%+ from 4801 to 7700 0.25%,
3)above 7700, 4800 * 0.35%+ from 4801 to 7700* 0.25% + 7701 to 8200 *0.17% and
4)over and above, 4800 * 0.35%+ from 4801 to 7700* 0.25% + 7701 to 8200 *0.17% + more than 8200 * 0.09%.

But the pensioner who retires before july 97 will get DA calculated on the basis of 50% of the above amount, ie.
1)upto 2400 0.35%,
2) above 2400 upto 3850, 2400 0.35%+ from 2401 to 3850 0.25%,
3)above 3850, 2400 * 0.35%+ from 2401 to 38500* 0.25% + 3851 to 4100 *0.17% and
4)over and above, 2400 * 0.35%+ from 2401 to 3850* 0.25% + 3851 to 4100 *0.17% + more than 4100 * 0.09%.

The above details will show you the difference of pension. This anomoly was referred to the LIC management and they have readily agreed and passed a resolution in their Board to pay the same which was not agreed to by the Union Govt. Hence the case and the case was won by the pensioners at Division Bench level and the Management at the instance of the Govt. petitioned for review by the Division bench itself which was kept pending and the pensioners of LIC moved Contempt of court.

This ended up in SLP in Sup.Court, moved by the LIC management and the Sup.Court has now ordered review of the decision within three months by the same High Court and stayed the contempt proceedings.

Many of the members of our Association have put questions like, in what way this is going to help us.
This decision, if upheld by Supreme Court, will benefit all the retirees, retired before 31/7/97 in our industry also , and the main verdict clearly speaks about the differentiation among pensioners, who come within the purview of the same scheme is not allowed as several decisions of the Apex court has clearly stated that group among group in pensioners cannot be allowed and there can be cut off date only at the time of introduction of the Scheme and not after that.

Now let us come to the point on how we fall in the above category. We are all governed by the scheme published in 1975 enacted in the parliament and amended from time to time, to revise the pay scales and other benefits, whereas the pension is not revised as and when the pay scales are revised.
This leads to creation of group among group, thereby creating difference in in the pension received, who retired at different period. I am giving you example of the same hereunder.

The above example will show you where we stand and we will be getting lesser and lessere when the scheme amended time to time without revising the pension which is legitimate.

We are also contemplating on filing a case for equality in pension and we are waiting only for the outcome of our case which is primary responsibility on us.

SUCCESS FUL CONDUCT OF OUR GENERAL BODY MEETING ON 27 02 11

Friends,
We take this opportunity to thank all the participants of our General Body Meeting held on 27/02/11. The meeting was attended by more than 50 delegates from outside and 250 members of Chennai. There were two sessions and it started in the morning at around 10.30 am with Prayer and address by our President Sri.RaviShanker. Our Chief Guests Sri.Philip, DGM New India and Sri.Poopathy RM National graced the occassion with their nice inter action with our members and promised all sort of help from their end to the Retirees.
Our General Secretary read the Report and followed by the presentation of Accounts for two years by our Treasurer Sri.M.K.Murali. There was an open house session with the members. And all the delegates were given opportunity to vent thier views.

In the afternoon session the agenda was only to discuss about the Supreme court Case. Our Senior Advocate Sri.Parthiban was kind enough to be present and interacted and answered all the quieries raised by our delegates. We collected the view points from all the delegates for further action and the meeting was over by Evening around 5.30 pm.

We are still getting emails, phones and letters from our delegates for the best arrangement we had made for their stay and for the way we conducted the meeting.

We take this opportunity to thank all the delegates thru' this web site for their sincere participation and we strongly feel that we will achieve all the goals with the full co-operation and participation of our members.

CREATING AWARENESS AMONG SVR OPTEES.

Dear Friends,
Our Association took up the cause of fighting the case for SVR OPTEES and in continuation of the same our office bearers under the leadership of our General Secretary went on a whirlwind tour of the country, just to explain the need of oneness among ourselves and for strengthening the finance of our Association.

The one point agenda was to explain the Retirees and SVR optees about the need to come together and fight the final battle with all Strength and determination. In the process, we were successful in getting more members and also an understanding among Retirees that our Association is the ONLY ONE among many Retirees Association to project the cause of Retirees with utmost sincerety either with the Management or the Government.

We have invited representatives from all over the country to attend the General body meeting on 27th Feb 2011 and almost all have confirmed their participation.

We expect DGM of New India and RM of National to participate and grace the occassion.

May God be with us in all our actions and inactions in getting our legitimate demands.

Our Sixth General body meeting

Dear friends,
We are holding our General Body Meeting at Chennai on 27th Feb 2011. The venue of the meeting is Venkatesa Vivaha Mandir. T.Nagar (near Panagal Park).

There will be two sessions one in the morning from 10 A.M. to 1 P.M. for transacting the usual business of passing of Accounts and reading of Secretary's Report etc. In the afternoon session Executive members from all over the country will participate and discuss the mode of approach we should follow in the final Trial of the Supreme Court Case. Our Advocate Sri.Parthiban will give his opinion about the case at the end of the Session.

Members are requested to send their additional legal fund amount of RS.1000/- and subscription due if any in advance or pay it on the day itself.
