Whatever further legal options are available must be tried.
Now it is also established that as per SC's previous judgement/expressed in judgement notional credit of 5 years to entitled SVRS optees stays.
Our association should also file a case in HC for compliance of judgement of SC with regard to grant of 5 years notional credit.

I think a suitable letter should be drafted by our association addressed to CJ of SC of India mentioning gross anomalies in judgement & should be submitted individually by all svrs optees for justice. Let CJ receive thousands of such petitions by registered post.

SVRS LATEST DEVELOPMENTS :
Dear friends
Our Review petition in Sup.Court got dismissed yesterday and contrary to the expectation of many, justice denied.
Now what?
I was at Ludhiana when the case was taken up by the Judges and all of us prayed in the meeting at 1.45 pm. The expectations from the members present in the meeting was optimistic. We discussed the future course of action if dismissed. Almost all the members were appreciative of our struggle and encouraged us to fight for the justice.
But now since the petition is dismissed we should think about the future course of action.
We had consultation with the Advocates and as well others who are experts in law and we are going to have a discussion at Chennai tomorow with Advocate and as well with our Executive committee members on Monday and will come back to you after that.
We have actually partly won the case since the Judgement of the Supreme court was based on the assumption that we were paid the 5 years notional credit, and we are eligible for it. only thing is that we should take legal steps to get that if denied by the Management.
We are going to approach the management officially and also through Court if denied we will take the legal course of Contempt of court proceedings in the supreme court.
To the best of our knowledge, around 80 to 85 % of the pensioners are benefited by the decision and those who have opted for PF and who have completed 33 years of service will not be eligible for the 5 years notional credit.
Pensioners who have come out with less than 33 years of service will be benefited, between 1 to 5 years, subject to their retirement age.
We will come back to you after deciding upon the future course of action and we seek your co-operation in getting the legitimate due.
There were also criticism from some of the members that the leadership has not properly handled the case and spoiled it.
Let me declare before you all, on behalf of the office-bearers and other executive members who relentlessly worked for more than 10 years, that we took up this case with utmost sincerity and worked with a single point agenda of winning the case
We appointed the best Advocates available to fight our case from day one and the Advocates have argued so effectively that on the final day of argument the representatives of the management came out and openly appreciated that our Association have almost won the case.
We gave the best written submissions to the court, which was wet by two or three Retired Judges of the Supreme court before submission to the court.
Fact remains that we fought mainly for the arrears of 20 months and consequential benefit of pension but to our surprise the Judges have completely misunderstood the case and dismissed it with a wrong presumption of fact.
We can not vouch for the erroneous judgement delivered. We are more disappointed than any one of you, but taken the result in right spirit and we should move on to get the benefits to atleast the pensioners who are eligible for the 5 years notional credit.
In any fight there are two sides. But God is so good that he gave benefit to 85 % of the pensioners and leaving out the other 15%. Let us take things as it comes and be satisfied with what we get.
Seeking full co-operation from you all in the further fight of pension updation. Our Association will continue its fight for the pensioners till such time you are all with us.

Dear friends,
Thank you all for sharing your opinions about the conducting of the case and also about the future course of action.
We have taken conscious decisions in the above matters after thoroughly analysing the pros and cons of the actions to be taken.
We are going to send letters to all the Chairman of the Companies asking them to honour the Supreme Courts order on 5 years notional credit. The letters have already been prepared with the consultation of the lawyers and suitably worded, and most likely to reach the Offices of the Chair man of the Five subsidiaries of General insurance.
We are also going ahead with the legal procedures to get a reply from the Management on the above demand of 5 yrs.notional credit.
The second approach is to consult Sup. Court lawyers and Retired Sup. Court Judges on the possibilities of Curative Petition. and also the financial implications.
We will reach you as and when we decide. Seeking full co-operation in the above matter.

In Our petition for payment of 5 years notional credit at Madurai
court today order issued to Management to reply within 4 months
weather they would pay or not.
